सरकारी ठेकेदार ठेके के चलते नहीं हो सकते चुनाव में प्रत्याशी

कोई भी व्यक्ति जिसने अपने व्यवसाय या काम के सिलसिले में सरकार को माल सप्लाई करने या किसी काम का निष्पादन करने के लिए कोई कंट्रेक्ट किया हो और वह कंट्रेक्ट चालू हो तो वह चुनाव में उम्मीदवार नहीं हो सकता। जन प्रतिनिधित्व कानून की धारा 9-ए के अंतर्गत इस तरह के व्यक्तियों को अयोग्य घोषित किया गया है। यह धारा निम्न प्रकार है ….

9A. Disqualification for Government contracts, etc.

A person shall be disqualified if, and for so long as, there subsists a contract entered into by him in the course of his trade or business with the appropriate Government for the supply of goods to, or for the execution of any works undertaken by, that Government.

Explanation.

For the purposes of this section, where a contract has been fully performed by the person by whom it has been entered into with the appropriate Government, the contract shall be deemed not to subsist by reason only of the fact
that the Government has not performed its part of the contract either wholly or in part.

इस के स्पष्टीकरण के अनुसार यदि ऐसे कंट्रेक्टर ने कंट्रेक्ट का अपना दायित्व पूरा कर लिया है और केवल सरकार को उस का दायित्व पूरा या आंशिक रूप से पालन करना शेष है। उदाहरणार्थ किसी व्यक्ति ने माल सप्लाई का कंट्रेक्ट सरकार के साथ किया और माल सप्लाई कर दिया या किसी सड़क को बनाने का कंट्रेक्ट सरकार के साथ किया और सड़क निर्माण पूरा कर दिया और अब सरकार से उस माल की सप्लाई का या सड़क निर्माण का पूरा या आंशिक भुगतान उसे प्राप्त होना शेष है तो इसे अयोग्यता नहीं माना जाएगा और ऐसा व्यक्ति चुनाव में प्रत्याशी हो सकता है।
